ŞANI EKSİLMİŞ- FADED GLORY

2012, Ekim’in 16’sıydı. Kapımıza yapıştırılmış imzasız bir yazı buldum. Penceremde asılı soluk baayrağımıza dikkatimi çekiyor, bunu suç olarak tanımlayan kanun maddelerini naklediyordu. Şaşırtıcı birşey yoktu bunda; bayrak 13 Nisan 2009’dan beri asılıydı.

O tarihte “12nci Ergenekon dalgası” ile toplam 60 kişi gözaltına alınmıştı. Gözaltına alınanlar arasında akademisyenler Mustafa Yurtkuran, Ferit Bernay, Fatih Hilmioğlu, ve Başkent Üniversitesi kurucu rektörü, organ nakli uzmanı Mehmet Haberal vardı.

Duyduğum rahatsızlık ve çaresizlik beni birşeyler yapmaya dürttü. O akşam pencereme bayrağımı astım ve “bu insanlar serbest bırakılmadıkça bu bayrak inmeyecek” dedim. Büyük lâf etmişim. Ergenekon sanıkları hâla içeride, mahkemeler hâla sonuçsuz, bazısına yöneltilen belirgin bir suçlama bile yok. Mahmet Haberal ne ile suçlandığını bilmediğini tekrar tekrar belitti.

Astığım- ve şimdi solmuş olan- bayrağım, benim için özellikle önemli bir bayraktı; yurtdışında geçirdiğim yıllarda bana refakat etmişti, meleğimin en yüksek noktası olan Disney yıllarında yanımda masamın bir rafında katlı duruyordu.

Bayrağım şimdi güneşten iyice ağarmış durumda! Rüzgâr kenarlarını sökmüş. Komşum haklı yani. Ve bayrağı bu durumda asmak gerçekten de suç!

Ancak, insanları gerekçesiz hapsetmek de suç! Vatandaşın böyle bir haksızlığa uğramayacağının güvencesi de bu bayraktı! Artık bu güvenceyi vermiyorsa, temizmiş, ütülüymüş, kırmızısı parlakmış,ne anlamı kaldı? (Dr. Haberal kendini tahliye etmeyen hakimlere karşı açtığı davayı kazandı, dokuz hakimin her biri 1500'er TL tazminat vermeye mahkum edildi. Ama bu Dr. Haberal'ı bulunduğu durumdan kurtarmadı. Haziran 2010'daydı, o tarihten beri bile iki yıldan fazla zaman geçti!)

Bayrağın durumu, milletini ve bayrağını bu kadar çok seven bu aydın insanların ömürlerinden çalınan yılları belirgin bir şekilde gösteriyor. Şanından birşeyler eksilmiş gibi gözükse de eksilen, bu büyük adaletsizliği bu kadar rahatlıkla sineye çeken milletin şanıdır.

Çok cesur bir insan olmadığım için verdiğim söze rağmen “mahalle baskısına” boyun eğdim ve, bayrağı indirdim. İnat edebilirdim, mahkemelik olmayı bekleyip, davamı Ergenekon sanıklarının durumuna dikkat çekmek için kullanabilirdim (Emile Zola tarzı!) ama adalet sistemine pek güvenemediğim için bu kadar ümitsiz bir mücadeleye kendimi hazır hissetmedim.

 Solmuş bayrağım- My faded flag

On October 16th 2012, I found an anonymous note stuck to our door. A neighbour was drawing my attention to the faded flag at the window, quoting te relevant laws that make it a crime to display a faded and torn flag. No wonder; it was hanging since April 13th, 2009.

On that day, in yet another “Ergenekon” razzia, “the 12th wave”, a total of 60 people were taken in custody, among them academicians Mustafa Yurtkuran, Ferit Bernay, Fatih Hilmioğlu, and most notably Mehmet Haberal, accomplished transplant surgeon, founder and rector of Başkent  University, Ankara.

In a fit of indignation I hung up my flag from my window, saying “this flag stays here so long as those people are in prison!” Big words! How could I know these people would be kept behind bars for so long? Mr. Haberal still professes ignorance as to why he is there.

I shared all of this with friends and acquaintances by e-mail, as well as on this blog. (See "The Flag and the Ribbon", May 30th 2012).

That flag was important to me- it had accompanied me during my years abroad as an animator; it lay folded on a shelf of my desk during my proud years at the Disney studio.

Now the flag is practicaly bleached by the sun, tattered and frayed. So my anonymous neighbour is right. And yes, it is against the law!

But it is also against the law to incarcerate people without verdict, without even a case against them. The flag was supposed to be a safeguard for citizens against injustice and a guarantee for a fair trial. If it no longer provides these, what’s the point of having it bright red, washed and pressed?

The glory is indeed faded, not of the flag but of the nation that allows such blatant injustices towards people most dedicated to it. The state of the flag visibly demonstrates the passage of time, the years taken away from the lives of illustrious, patriotic intellectuals still incarcerated without verdict, and even without a clear case against them! (Dr. Haberal brought his own judges to court for keeping him in prison, won the case, the nine judges had to pay him 1500.-TL each in compensation, but this did not secure his release. That was in June 2010, more than two years ago.)

Bowing to pressure from the neighbours, and not being the bravest of men, I have broken part of my promise. I could have been obstinate, wait to be charged, and used the case to attract more attention to the injustices of the Ergenekon trials (Emile Zola style), but with the judiciary system highly suspect, I did not feel prepared for such a hopeless battle! The faded flag is now down!

A new flag has taken up the post, the black ribbon remains!
